LIMITATION OF LIABILITY, TERMS OF USE, AND INTERNAL RULES – COLOMBIA SINTROPÍA S.A.S.
Colombia Sintropía S.A.S., in compliance with current Colombian legislation and with the aim of ensuring safety, legality, and respect within its premises, informs all guests, contractors, visitors, and third parties that entering, remaining in, or participating in activities within the grounds of the Sintropia hostel implies the express and informed acceptance of the following provisions:
NATURAL RISKS AND ACTIVITIES
The natural and geographic environment in which the hostel is located presents inherent risks due to its topography, wildlife, changing weather conditions, and limited access. These risks include, but are not limited to: accidents in areas with difficult access, exposure to heavy rains, fog, strong winds, presence of wild animals, landslides, falling debris, among others.
Colombia Sintropía S.A.S. will not be liable for accidents, incidents, or personal or material damages occurring during activities carried out within or outside its facilities, whether as a guest, worker, supplier, or visitor. Every individual entering the premises voluntarily assumes these risks and expressly releases the company and its staff from any non-contractual civil liability.
TRANSPORTATION SERVICES
Colombia Sintropía S.A.S. does not provide direct transportation services. Any hiring, use, or recommendation of transport, excursions, or access services to the facilities is the sole responsibility of the user.
Third-party responsibility: Any damages, losses, delays, or accidents occurring during transport services are the responsibility of the provider and the contracting user.
Use of personal vehicles: Sintropia does not have parking facilities and is not responsible for vehicles located near its premises.
Outsourced transportation: If contact with tour operators is facilitated, Sintropia acts solely as an informational intermediary, without assuming any responsibility for the quality, compliance, or safety of the service.
CODE OF CONDUCT AND LEGAL RESTRICTIONS
In accordance with Colombian laws (Law 1335 of 2009, Law 30 of 1986, Law 599 of 2000, and other applicable regulations), the following behaviors are strictly prohibited within the hostel:
- Smoking in rooms, social areas, or enclosed spaces (only allowed in designated areas).
- Consuming alcoholic beverages not purchased from the establishment.
- Possessing, distributing, or consuming narcotic or psychotropic substances.
- Carrying firearms, sharp objects, or restricted-use weapons.
Violation of these provisions will result in immediate termination of the lodging without the right to a refund and may lead to administrative sanctions or criminal charges.
PROHIBITION OF SEXUAL TOURISM AND PROTECTION OF MINORS
Colombia Sintropía S.A.S. rejects and penalizes all forms of commercial sexual exploitation of children and adolescents, in accordance with Law 679 of 2001 and Law 1336 of 2009.
- Participation in activities involving exploitation, abuse, or child pornography is strictly prohibited.
- All minors must present identification and, if not accompanied by their parents, a notarized authorization along with copies of the guardians’ IDs.
- Any indication of such activities will be immediately reported to the competent authorities.
Sintropia has adopted a Code of Conduct in accordance with Resolution 3840 of 2009, promoting responsible tourism and the protection of human rights.
PROTECTION OF FAUNA, FLORA, HERITAGE, AND HUMAN RIGHTS
Colombia Sintropía S.A.S. prohibits:
- The trafficking, commercialization, or illegal possession of flora, fauna, or cultural assets (Law 17 of 1981 and Law 397 of 1997).
- Acts of racism, discrimination, or violence based on sexual orientation or gender identity (Law 1482 of 2011).
- Violations of the rights of Indigenous, tribal communities, or people displaced by armed conflict (ILO Convention 169).
Any behavior that violates these provisions will be reported to the relevant authorities and may result in administrative and criminal sanctions.
FINAL STATEMENT
Entering the grounds and facilities of the Sintropia hostel constitutes full and unconditional acceptance of this Legal Notice. Those who do not agree with these terms must refrain from entering or remaining on the premises. Colombia Sintropía S.A.S. reserves the right to modify or update these provisions at any time, in accordance with the current legal framework and the safety of its facilities.
LIMITACIÓN DE RESPONSABILIDAD, CONDICIONES DE USO Y NORMAS INTERNAS – COLOMBIA SINTROPÍA S.A.S.
Colombia Sintropía S.A.S., en cumplimiento de la legislación colombiana vigente y con el propósito de garantizar la seguridad, legalidad y respeto en sus instalaciones, informa a todos sus huéspedes, contratistas, visitantes y terceros que el ingreso, permanencia y participación en actividades dentro de los predios del hostal Sintropia implica la aceptación expresa e informada de las siguientes disposiciones:
RIESGOS NATURALES Y ACTIVIDADES
El entorno natural y geográfico en el que se encuentra ubicado el hostal presenta riesgos inherentes derivados de su topografía, fauna silvestre, condiciones climáticas cambiantes y accesos limitados. Estos riesgos incluyen, pero no se limitan a: accidentes en zonas de difícil tránsito, exposición a lluvias intensas, neblina, viento fuerte, presencia de animales silvestres, deslizamientos, caídas de material, entre otros.
Colombia Sintropía S.A.S. no será responsable por accidentes, incidentes o daños personales o materiales ocurridos durante actividades desarrolladas dentro o fuera de las instalaciones, ya sea en calidad de huésped, trabajador, proveedor o visitante. Cada persona que ingrese a los predios asume voluntariamente estos riesgos y exime expresamente a la empresa y a su personal de cualquier responsabilidad civil extracontractual.
SERVICIOS DE TRANSPORTE
Colombia Sintropía S.A.S. no ofrece servicios de transporte directo. Cualquier contratación, uso o recomendación de servicios de traslado, excursión o acceso a las instalaciones será responsabilidad exclusiva del usuario.
- Responsabilidad de terceros: Los daños, pérdidas, demoras o accidentes ocurridos durante servicios de transporte son responsabilidad del proveedor y del usuario contratante.
- Uso de vehículos propios: Sintropia no cuenta con parqueadero ni se hace responsable por vehículos ubicados en sus inmediaciones.
- Tercerización de transporte: En caso de facilitar el contacto con operadores turísticos, Sintropia actúa exclusivamente como intermediario informativo, sin asumir compromiso alguno sobre la calidad, cumplimiento o seguridad del servicio.
NORMAS DE CONDUCTA Y RESTRICCIONES LEGALES
Conforme a las leyes colombianas (Ley 1335 de 2009, Ley 30 de 1986, Ley 599 de 2000 y demás disposiciones aplicables), están estrictamente prohibidas las siguientes conductas dentro del hostal:
- Fumar en habitaciones, áreas sociales o espacios cerrados (permitido solo en zonas señalizadas).
- Consumir bebidas alcohólicas adquiridas por fuera del establecimiento.
- Poseer, distribuir o consumir sustancias estupefacientes o psicotrópicas.
- Portar armas de fuego, cortopunzantes o de uso restringido.
La violación de estas disposiciones será causal de terminación inmediata del hospedaje, sin derecho a reembolso, y podrá acarrear sanciones administrativas o denuncia penal.
PROHIBICIÓN DEL TURISMO SEXUAL Y PROTECCIÓN A MENORES DE EDAD
Colombia Sintropía S.A.S. rechaza y sanciona toda forma de explotación sexual comercial de niños, niñas y adolescentes, conforme a la Ley 679 de 2001 y Ley 1336 de 2009.
- Se prohíbe la participación en actividades que impliquen explotación, abuso o pornografía infantil.
- Todo menor de edad deberá presentar documento de identidad y, en caso de no estar acompañado por sus padres, autorización autenticada y copia de cédulas de los responsables.
- Cualquier indicio será denunciado inmediatamente ante las autoridades competentes.
Sintropia ha adoptado un Código de Conducta conforme a la Resolución 3840 de 2009, promoviendo el turismo responsable y la protección de los derechos humanos.
PROTECCIÓN DE LA FAUNA, FLORA, PATRIMONIO Y DERECHOS HUMANOS
Colombia Sintropía S.A.S. prohíbe:
- El tráfico, comercialización o tenencia ilegal de flora, fauna o bienes culturales (Ley 17 de 1981 y Ley 397 de 1997).
- Actos de racismo, discriminación o violencia por orientación sexual o identidad de género (Ley 1482 de 2011).
- La afectación a los derechos de comunidades indígenas, tribales o personas desplazadas por conflicto armado (Convenio 169 de la OIT).
Toda conducta que transgreda estas disposiciones será reportada a las autoridades competentes y podrá dar lugar a sanciones administrativas y penales.
DECLARACIÓN FINAL
El ingreso a los terrenos e instalaciones del hostal Sintropia implica la aceptación plena y sin reservas del presente Aviso Legal. Quienes no estén de acuerdo con estas condiciones deberán abstenerse de ingresar o permanecer en las instalaciones. Colombia Sintropía S.A.S. se reserva el derecho de modificar o actualizar estas disposiciones en cualquier momento, en función del marco legal vigente y de la seguridad de sus instalaciones.
